I was looking on a website called IR Plant and Garden Centre. I looked up 'Cotoneaster cornubia' and saw that one of the photos they use to advertise it is MINE !' Here is a link to the page www.irgardencentre.com/product-p/cotoneaster-cornubia.htmIf you follow the link you will see that they have two photos of C. cornubia, and the second one is MY TREE IN MY GARDEN ! Here is my photo which is in my photo album on my computer, and if you compare it to the 2nd one on their website, you'll see it's the same photo ... I have sent them an email asking why are they using my photo without my permission.

That's really sneaky. Copyright is a very foggy issue on the internet. It's a very nice photo though, I can see why they pinched it, it shows the bush off very nicely.

I think if it's on one of the sites where pictures are stored anyone can use them unless they are marked as 'private' Photobucket has the option, if you don't want them seen by the public you can make all your pictures only available to yourself or nominated people

It's being used by someone on ebay as well Eli as is another of your photos of the same plant in your garden from a different angle! I googled cotoneaster cornubia images & your photo comes up on the first page about 7 lines down, if you click on the image it shows up as being used on ebay by someone using the name 'maryw1890' trading as Pretty Petals Plant Shop but actually using the other photo of yours from another angle & the close-up photo used by the site you found yours on. They do say 'images may be subject to copyright' but people must take no notice & use them anyway, your photos are probably all over the internet Eli!

There is a large thread about this issue on the Scottish Rock Garden website. Seems to be a big problem. Never looked to see if any of my images are being used on Ebay. All of mine when sent to Photobucket have a copyright image embedded in them, so they would have to go to the trouble of removing it. Did that after someone took one of my photos, slightly altered it and won a competition with it.

It is a bit cheeky, no harm in contacting them about it Eli. Graham has had a few of his car pictures used on Wikipedia and in books and calenders, mostly the people who used the pictures asked permission apart from Wiki but his pictures are public on Flickr and he doesn't really mind

I actually don't mind someone borrowing my photos if it helps them. I am not a spiteful person. However I would like to be asked first. If they'd asked I probably would have said 'yes', but being taken forgranted is something that really annoys me.
I have sent to three places which have stolen my photo, and I shall tell them so when I get replies.
The ebay one has finished "because the item is no longer available".
Some of the images seen are from Grows on You - another garden forum I belong to.

I suspect that anyone using the images for commercial purposes could be on a sticky wicket, and you would have a right of redress. (probably limited to asking them to be removed).

I've had a reply from one of the places, and they said they don't know how it happened ! I do ...
I have told them they can keep the photo, but made sure they knew I am not happy about it being taken without my permission. I shall say the same to the others when (if) they reply.
